1. Processing of Personal Pata

This notice is provided – pursuant to Article 13 of the EU Regulation No. 2016/679 to users who, as visitors of the “Sentieri dei Marcati” trails, use the dedicated website (hereinafter Site) and the Android or IoS App (hereinafter App) specifically made to collect and review information about the trails and nearby points of interest. The information contained on this page does not extend to other websites that may be accessed through hyperlinks on the Site or the App. Users, by using the Site or the App with a device (smartphone or tablet) Android or Ios, accept this policy on the processing of personal data and are, therefore, invited to read this notice entirely before providing personal information of any kind. The processing is based on the principles of fairness, lawfulness, relevance and transparency and protecting the confidentiality and rights of the data subject in accordance with the law.

2. Subjects involved in data processing

4. Types of data processed, purpose and legal basis for processing

The computer systems and software procedures responsible for the operation of the App and the Site acquire certain personal data relating to navigation, the transmission of which is implicit in the use of Internet communication protocols (for example, the IP address or domain names of the devices through which visitors connect to the site, the URI – Uniform Resources Identifier – notation addresses of the pages requested, the type of browser, the type of device, etc.).
This information is not collected in order to be associated with identified data subjects, but only for the purpose of obtaining anonymous statistical information on the use of the Site and to monitor its proper functioning.

In addition, visitors to the Site can register their own user account by providing an email and password, and by accessing their own restricted area they can create personalized hiking trails within the “Sentieri dei Marcati”. This data is processed exclusively to provide information related to the trekking routes chosen both through the Site and the App. By using the App, the user can see on a map their location and information related to the selected route, however, no storage of actually followed routes or gps locations of the visitor is made either on the App device or on the Site and there is no transmission of this data to external platforms.

During the process of registering on the Site, the user is asked to give free and explicit consent that the aforementioned data be used for the sole purpose of using the service and be disclosed to third parties only in cases where this is permitted by law. In the absence of consent, the Site will not allow user registration.
Under no circumstances will the data collected be used to perform user profiling.

There are no other types of personal data processing and only technical cookies necessary for the Site to operate the service are used.

5. Processing methods

Data are processed in relation to the described purpose and with related logic in accordance with the principles set forth in Article 5 of Regulation (EU) 2016/679, in a manner that ensures adequate security, including protection against unauthorized or unlawful processing, through appropriate technical and organizational measures. Based on the data covered by this notice, the Administration will not make any decisions by fully automated processing, nor will any automated profiling be carried out.

6. Communication and dissemination of data

The data collected during browsing may be processed for the purposes set out in this statement by the subjects mentioned in point 2 and the persons authorized by them to process them.
The data may be subject to communication in the cases and in the manner provided by law.
The data will not be communicated to other subjects. Furthermore, the data may be accessed by Servizi Speciali S.r.l. , with an address in Palermo via Nicolò Gallo 3, email info@servizispeciali.it, pec amministrazione.servizispecialisrl@pecpu.telecompost.it, telephone +39 0919100753 for the purpose of system administration and technical assistance. The legal basis for processing by the aforementioned subjects is Art. 6.1a, which applies in cases where the data subject has given consent.

7. Data retention

For the purposes of the processing, the data are kept at the offices of the parties mentioned in point 2. Web server log data will be kept for one week and then will be deleted or anonymized, unless it is necessary to keep it for a limited period of time to solve a technical problem in the systems, after which it will be immediately deleted or anonymized . There are no other personal data subject to retention. In case the data are used for ascertaining liability in hypothetical cases, the time limits for deletion are suspended in accordance with the law.

8. Rights of the data subject

The user may exercise his/her rights under Articles 15 to 22 of EU Regulation 679/2016 on personal data concerning him/her and in particular the right to access personal data, rectification and erasure, restriction of processing, notification obligation and portability of data, by sending a communication to the Controller at one of the addresses indicated in point 1.

The computer systems and software procedures responsible for the operation of the Marked Paths App and Site use only technical cookies.

For their use, it is necessary to inform the user about the data acquired and obtain his free and explicit consent.

– Third-party cookies related to “social plugins”
Social plugins are parts of the page visited in which there is a link or button that allows you to share content with the social network concerned (Facebook, LinkedIn, Twitter, Pinterest, Youtube, etc.). The presence of these plugins involves the transmission of data to the social network and the storage of cookies managed by third parties in which the user profile used in the social network, IP address, etc. may be recorded. For their use it is necessary to inform the user about the acquired data and obtain his free and explicit consent.
